These Terms of Use govern your access to and use of arkonmed.com (the “Site”) and any products purchased through it (the “Products”). By using the Site or purchasing Products, you agree to these Terms.
Research use only
All Products sold through Arkon are supplied for research and analytical use only. Products are not intended for human or veterinary administration, clinical diagnosis, or therapeutic application. Purchasers are responsible for complying with all applicable laws governing research use.
Not a compounding pharmacy
Arkon is a supplier of research materials. Arkon is not a 503a or 503b compounding pharmacy, and nothing on the Site should be construed as compounding, dispensing, or practicing pharmacy.
No medical advice
Information on the Site does not constitute medical or clinical advice. No doctor-patient relationship is created by use of the Site or by communication with Arkon personnel.
Eligibility
Purchase of Products is restricted to verified research providers holding an active NPI registration and a valid state medical license (or equivalent professional credential acceptable to Arkon). Misrepresentation of credentials voids any purchase and may be reported to regulatory authorities.
Limitation of liability
To the fullest extent permitted by law, Arkon and its affiliates are not liable for any indirect, incidental, consequential, or punitive damages arising from use of the Site or Products, including damages arising from any use of Products outside their intended research scope. Our aggregate liability for any claim related to a Product is limited to the amount paid for that Product.
Indemnification
You agree to defend, indemnify, and hold harmless Arkon, its officers, directors, employees, and agents from any claim, damage, or expense arising out of your use of Products or breach of these Terms.
Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Disputes shall be resolved exclusively in state or federal courts located in Orange County, California.
Changes
Arkon may update these Terms. Material changes will be noted with a revised “Last updated” date. Continued use of the Site after changes constitutes acceptance.
